1. Introduction
Welcome to Crucible Care Co.. By accessing our services you agree to the following terms and conditions. Please read them carefully as they govern your use of our services.
2. Legal Jurisdiction
These terms and conditions are governed by the laws of the State of Delaware, United States. Any disputes arising out of or related to these terms shall be subject to mediation in the State of New York, United States. Remote mediation or arbitration is allowed if both parties agree, particularly for customers who are not in New York.
3. Scope of Services
Membership: Facilitates onboarding as an egg donor on behalf of an agency. Facilitates planning, task management and information collection.
4. Geographic and Service Limitations
Our services are not geographically restricted. However, we only provide support for egg donation.
5. Database Accuracy
We strive to maintain accurate and up-to-date information in our application. However, we do not guarantee that the information is entirely accurate, and we cannot be held liable for any inaccuracies or outdated information. The application is reviewed regularly to ensure the highest possible level of accuracy.
6. Liability and Disclaimers
Medical Outcomes: Outcomes of fertility procedures can vary widely and are not guaranteed. Crucible Care Co. does not guarantee that you will have a positive experience with any agency who uses our software.
Limitation of Liability: Under no circumstances shall Crucible Care Co. be liable for any adverse outcomes, including but not limited to medical complications or unsuccessful procedures, resulting from the use of any agency that uses our software. By signing up for an account, you agree to release Crucible Care Co. from any claims, damages, or liabilities associated with your fertility treatment journey.
Explicit Acknowledgment: By signing up for an account, you explicitly acknowledge and accept the risks involved in fertility procedures and the limitations of Crucible Care Co.'s liability.
7. User Responsibilities
Customers are solely responsible for conducting their own research and due diligence before working with a clinic or agency. Crucible Care Co. does not replace the need for professional medical advice and consultation.
8. Privacy and Data Protection
We collect basic identifying information such as name, email, age and location. Additional confidential information may be shared with us at the customer's discretion. All customer data is protected in secure systems. We may share customer information with third parties, such as the agency you are working with, but not for direct marketing purposes by the clinics
9. Dispute Resolution
In the event of a dispute, both parties agree to seek resolution through mediation before pursuing any other form of legal action. The party initiating the dispute must formally request mediation and suggest a mediator. The other party may agree to the suggested mediator or propose an alternative until both parties reach an agreement on the mediator. The costs of mediation will be split evenly between both parties. If mediation fails to resolve the dispute, arbitration will be used as a backup option.
10. Modification of Terms
Crucible Care Co. reserves the right to modify these terms and conditions at its discretion. Customers will be notified of any changes via email at least 30 days before the changes take effect. If customers do not agree with the new terms, they may opt out or delete their account without penalty.
11. Termination of Services
Crucible Care Co. reserves the right to terminate a customer's membership without notice if the customer is found to be acting in bad faith, abusive to staff, or in breach of these terms and conditions.
Consequences for the Customer:
Immediate loss of access to all services and resources.
Data may be retained or deleted according to our privacy policy.
Consequences for Crucible Care Co.:
The business will no longer be obligated to provide services or support to the terminated customer.
Legal protection from further claims or liabilities from the terminated customer.
